The standard process for an Arbitration conducted by the Employment Arbitration Centre will involve the following steps:
Step 1 Enquiry form completed.
Step 2 Enquiry processed and allocated to Arbitrator.
Step 3 Arbitrator will contact the parties and confirm acceptance of enquiry within 3 working days of receipt of the enquiry. Parties will be provided with information including:
- Draft Arbitration Agreement,
- Particulars of fees
- Forms for completion, seeking additional information and documents.
Step 4 A conference call will be convened with the parties for the purpose of:
- Addressing any issues that the parties have with the Arbitration Agreement.
- Discussing the process that will be followed at the Arbitration.
- Clarifying the issues.
- Exploring whether any additional documents are necessary and setting a timetable to produce those documents.
- Whether the arbitration will be face-to-face, on the papers or video conference.
- Clarifying who will attend the Arbitration. Availability and venue for the Arbitration.
Step 5 The Arbitration will be conducted.
Step 6 A decision will be issued.
